Terms of Service
The rules that apply when you use Magnifyr. Short version: be reasonable, we'll be reasonable. Long version below.

1. Acceptance
By creating a Magnifyr account, connecting a social platform, or loading the tracking pixel on a website you operate, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, do not use the service.
These terms apply to both the marketing site at magnifyr.co.za and the application at app.magnifyr.co.za.
2. The service
Magnifyr is a multi-tenant SaaS platform operated by Agilus (Pty) Ltd that lets you:
- Schedule social media posts across LinkedIn, X, Facebook, Instagram, and TikTok.
- Generate AI-assisted post drafts that you approve before publishing.
- Capture and manage leads through landing pages, a tracking pixel, and a built-in CRM.
- Trigger workflow automations on lead events (scoring, stage changes, form submissions).
The service is offered “as is” during the current soft launch. We will email account holders before any material change that reduces functionality.
3. Eligibility
- You must be at least 18 years old.
- You must be authorised to bind the business or workspace you register on behalf of.
- You must not be in a jurisdiction subject to sanctions that prohibit the use of Microsoft Azure services in the South Africa North region.
4. Your account
- You are responsible for keeping your password secure and for all activity that happens under your account.
- You must not share your account with people outside your tenant. Team members are added through the in-app invitation flow on paid tiers (when available).
- We may suspend or terminate accounts that violate these terms or use the platform to send spam, harass others, or break the rules of the underlying social platforms.
5. Acceptable use
You agree not to use Magnifyr to:
- Post content that is illegal under South African law, including hate speech, incitement, or unlawful discrimination.
- Send unsolicited commercial messages (spam).
- Impersonate another person or business, or post on behalf of someone without their consent.
- Circumvent rate limits, scrape the platform, or run automated attacks against our infrastructure.
- Capture leads without a lawful basis under POPIA or GDPR. Every lead in Magnifyr must have a recorded consent source.
- Use the AI content generation features to produce content that violates the usage policies of the underlying AI providers (Anthropic Claude, OpenAI).
You also agree to abide by the terms of every social platform you connect. We are not responsible for enforcement of LinkedIn's, X's, Meta's, or TikTok's rules — they enforce those themselves.
6. Free tier and (future) paid tiers
At the time of writing, only the Free tieris available. Paid tiers (Pro and Business) are communicated in-app and on the marketing site as “Coming soon”. We do not collect payment details until paid tiers launch.
When paid tiers launch we will publish updated pricing and counsel-reviewed billing terms. Existing free-tier accounts will not be auto-upgraded; you will need to explicitly opt in.
Tier limits (number of platforms, scheduled posts per month, landing pages, AI quota, team members) are enforced server-side. Attempts to bypass limits are a violation of these terms.
7. Your content and your data
You retain ownership of everything you put into Magnifyr — scheduled posts, uploaded media, lead records, landing-page content. We never claim a license to use it outside what is strictly required to deliver the service to you.
You grant us a non-exclusive, royalty-free license only to:
- Store, transmit, and display your content within the service.
- Send your content to third-party APIs you have authorised (e.g. posting to LinkedIn on your behalf when you schedule a post; sending your prompt to Anthropic Claude when you use AI drafting).
- Create encrypted backups for disaster recovery, retained for no longer than 30 days.
8. Third-party services
Magnifyr connects to and depends on services we do not operate. If any of them are unavailable or change their APIs, your experience may be affected. The principal third parties as of this revision:
- Microsoft Azure (hosting, storage, identity).
- LinkedIn, X (Twitter), Meta Platforms, TikTok (publishing APIs).
- Anthropic and OpenAI (AI content generation).
- Stripe (billing — once paid tiers launch).
- Azure Communication Services (transactional email).
9. Availability and SLA
The service is offered without a contractual uptime SLA during the current soft launch. We will publish a target SLA when paid tiers launch. The service may be unavailable for planned maintenance, unplanned outages, or third-party API failures.
A status page at status.magnifyr.co.za is on the roadmap.
10. Termination
You can delete your account at any time from inside the application. We hard-delete tenant data within 30 days of an account deletion request.
We may suspend or terminate your account if you breach these terms, if we are legally required to, or if the underlying social platforms revoke our access in a way that prevents the service from functioning.
11. Disclaimers
The service is provided “as is” and “as available”. To the maximum extent permitted by South African law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that AI-generated content will be factually accurate or commercially acceptable. You are responsible for reviewing every AI-drafted post before approving it for publishing.
12. Limitation of liability
To the maximum extent permitted by South African law, our aggregate liability to you for any claim arising from the service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) ZAR 1,000.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data, even if we were advised of the possibility.
13. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. The courts of South Africa have exclusive jurisdiction over any dispute arising from or related to your use of the service.
14. Changes to these terms
We may update these terms. Material changes will be emailed to active account holders at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
